Brighter Connections Applications & Analytics Ltd, operates under these Terms of Use (“Terms”) to provide you with on-line access to information about Brighter PSA (“us” or “we”) and the Services we offer. Our Terms of Use govern the access and use of our websites www.brighter-psa.com, help.www.brighter-psa.com and go.www.brighter-psa.com (“Websites”). The Terms apply to all users of and Visitors to our Websites.

By accessing, browsing or using our Websites you accept and agree to be bound by all of the Terms below, which also supplement the Subscriber Agreement. If you do not agree to be bound by these Terms then please do not access, browse or use our Websites.

We are registered in England and Wales under company number 10052360 and we have our registered office at Edgerton Villa, 22-24 Edgerton Road, Huddersfield, West Yorkshire, United Kingdom, HD3 3AD.

1. Permitted Use

We are pleased to provide information about Brighter PSA on our Websites which we encourage and permit you to use in accordance with these Terms.

2. Prohibited Use

You may use our site only for lawful purposes. You may not use our site:

• In any way that breaches any applicable local, national or international law or regulation,
• In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect,

• to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You agree:

• not to access without authority, interfere with damage or disrupt:
  • any part of our Websites,
  • any equipment or network on which our Websites are stored,
  • any software used in the provision of our Websites, or
  • any equipment or network or software owned or used by any third party.

3. Suspension and Termination

We will determine, in our discretion whether there has been a breach of these Terms through the use of our Websites. When a breach occurs, we may take such action as we deem appropriate.

Failure to comply with these Terms of Use constitutes a material breach of the terms upon which you are permitted to use our Websites and may result in our taking all or any of the following actions:

• Immediate, temporary or permanent withdrawal of your right to use our Websites,
• Issue a warning to you,
• Legal proceedings against you for reimbursement of all costs on an indemnity basis (including but not limited to, reasonable administrative and legal costs) resulting from a breach,
• Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of these Terms of Use. The responses described herein are not limited and we may take any other action we reasonably deem appropriate.

4. Downloading from Our Websites

Due to the nature of the internet we cannot guarantee that files available for downloading will be free of infection from viruses or other harmful programs or computer codes including but not limited to Trojan horses, worms, time-bombs, keystroke loggers, spyware or adware.

5. Brighter PSA Intellectual Property

All Brighter PSA trademarks and logos are owned outright by Brighter Connections Applications & Analytics Ltd and are the intellectual property of Brighter Connections Applications & Analytics Ltd. You agree not to infringe any of our rights in our intellectual property through the use of our Websites.

6. Exclusion of Liability

We exclude liability for (whether for breach, negligence, misrepresentation, or for any other reason) any loss or damage whatsoever incurred or sustained by you in connection with these Terms of Use whether such loss or damage is direct, indirect or consequential and including, without limitation: (a) loss of profit (b) loss of business (c) lost data (d) rerun time (e) inaccurate output (f) work delays (g) wasted staff or management time.

Without prejudice to the exclusion of liability stated above, Brighter PSA limits its liability in relation to a breach of these Terms of Use to £100.00.

We do not exclude liability for (a) death or personal injury caused by our negligence or the negligence of our employees or agents (b) for any matter where liability cannot be excluded or limited under applicable law in relation to these Terms of Use.

7. Changes to the Terms of Use

We may revise these Terms of Use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on the Websites.
